Terms of Use

These terms apply when you use The Web Cow at thewebcow.com (“The Web Cow”, “we”, “us”). By creating an account or using the site, you agree to them. Please also read our Privacy Policy, which explains how we use your personal data.

1. What The Web Cow is

The Web Cow is a marketplace where people list small websites for sale and buyers can message sellers and make offers. We provide the platform. We do not own the sites listed, we are not a broker, and we are not a party to the sale between buyer and seller, except for the fees described below.

We may check listings before or after they go live, but we do not audit or guarantee any site, its figures or its future performance.

2. Your account

• You must be at least 18 and able to enter into a binding contract.
• Give accurate details and keep them up to date. One account per person.
• Keep your password safe. You are responsible for what happens under your account.
• You need a confirmed email address to sell, make offers or send messages.

3. Selling

Listing a site is free. When you list a site, you confirm that:

• you own the site, or you have the right to sell it and everything included in the sale;
• the revenue, profit, traffic and other information you give is accurate, complete and not misleading, and you will share reasonable proof with serious buyers;
• the site does not break the law or anyone else’s rights, and does not spread malware, deceive its users or rely on content you are not allowed to use.

We may review a listing before it goes live, ask you to change it, or refuse or remove it. Figures are provided by sellers unless the listing is marked Bell Verified (verified revenue), which means the figures were read from a connected account at the time shown.

4. Fees

We charge a success fee only when a sale completes. There is no fee to list and nothing to pay if your site does not sell.

• The standard success fee is 5% of the final sale price, with a minimum of €25. The fee is never more than the sale price.
• Members of The Founding Herd (our lifetime offer) pay no success fee on sales up to €30,000. Above that amount, the standard fee applies. These terms stay with the member for the life of their account.
• We show you the fee before you publish a listing. The fee for a sale is fixed when the deal is created, at the rate that applies to you at that time.
• We may change our fees for the future. We will tell you before a change applies to you, and it will never apply to a deal already agreed.
• If you meet a buyer or seller through The Web Cow, keep the deal on The Web Cow. If a sale to someone you met here completes elsewhere within 12 months of your first contact on The Web Cow, the success fee still applies.

5. Offers

Buyers can buy at the asking price or, where the seller allows it, make an offer. Sellers can accept, decline or counter. Offers expire after 7 days if nobody answers. Accepting an offer marks the listing as under offer, but an offer is not a binding contract until payment is arranged and both sides have agreed the terms of the sale.

6. Paying and transferring a site

Our payment and transfer tools are still being built. Until they are ready, we will tell both sides how to complete a sale safely. Never send money to anyone who asks you to pay outside the steps we give you. For larger deals, we plan to use Escrow.com, which holds the buyer’s payment until the site has been transferred.

7. Buying

Do your own checks before you buy. Ask for proof of revenue and traffic, check who controls the domain, hosting and any accounts included, and get professional advice if you need it. A site’s past performance does not guarantee its future results.

8. Messages and reviews

• Be honest and polite. No spam, harassment, or sharing other people’s personal data.
• Only the buyer of a completed sale can review the seller, once. Reviews must be honest and about that sale.
• We may hide reviews or remove messages that break these rules.

9. Content you add

You keep ownership of what you post: listing text, screenshots, photos, messages and reviews. You give us permission to store, display and adapt it (for example, resizing images) so we can run the marketplace and show your listing to buyers. When you ask us to, we take screenshots of your site and draft listing text from your site’s public pages. Check everything before you publish, because you are responsible for your listing.

10. Suspending or closing accounts

You can ask us to close your account at any time. We may suspend or close an account, and take its listings off the market, if it breaks these terms, puts other users at risk or is used for fraud. Records that other people rely on, such as completed sales, reviews and messages, may be kept with your personal details removed.

11. Our responsibility

We work hard to keep The Web Cow running and safe, but we provide it “as is”. We are not responsible for the sites listed, for what buyers and sellers say or do, or for a sale between them. As far as the law allows, our total liability to you is limited to the fees you have paid us in the 12 months before the claim. Nothing in these terms limits any liability that cannot be limited by law, or your rights as a consumer.

12. Changes to these terms

We may update these terms. If a change is significant, we will tell you by email or on the site before it takes effect. If you keep using The Web Cow after that, the new terms apply.
